Federal District Court Judges And Same Sex Marriage Bans Collapsing!

The move toward same sex marriage churns on, with federal judges having utilized the 14th Amendment in four “Red” states in the past two months now to end the discrimination against gays marrying.

So on Valentine’s Day, it now looks more evident than ever that a national Supreme Court decision is in the offing, with Associate Justice Anthony Kennedy, who wrote the majority decision in Lawrence V. Texas in 2003 igniting the gay civil rights movement, likely to be the fifth and decisive vote in any case that goes to the high Court!

Who would ever have thought that Utah, Oklahoma, Kentucky, and now, newly turned “Blue” Virginia (the state of the Loving V. Virginia interracial marriage case in 1967), would see such rapid action to defy the bigots and the haters?

The federal courts have been the herald of the future in so much of modern history, as with Brown V. Board of Education on racial integration, and Roe V. Wade on abortion rights, and Lawrence V. Texas on gay rights, and the courage of federal district judges across the nation to push the Supreme Court toward a final determination of same sex marriage is an indication that often we have to leave it to appointed judges to lead us to our better side of human nature, the ending of discrimination and injustice!

Sadly, we see right wing evangelicals, Catholics, and Mormons fighting a rear guard action, which only makes one realize the evils of these organized groups that have in the past been on the wrong side of many moral and ethical issues, overlooking slavery, segregation, women’s rights, and now gay rights. This is a losing battle long term, and these groups fighting against progress and human rights will pay the price in loss of membership by their willingness to fight a battle that is already lost!

Message To Homophobes, Racists, Sexists, Nativists: This Is NOT The 1950s, It Is The 21st Century, So Get Used To It!

We have come a long way as a society since the 1950s, the height of the Baby Boom generation!

But we see that it is many Baby Boomers, mostly white and supposedly ‘Devout” Christians, who are unable to accept that society has changed, and that it is time for them to adapt!

Yes, gay and lesbian Americans have gained their rights, including marriage, in many states, and by federal law announced by Attorney General Eric Holder over the weekend. And yes, now we have an openly gay football prospect, Michael Sam, and we have people in all walks of life in the public sphere coming out as gay. The answer is “so what?” It is no longer acceptable to be advocating homophobia in the name of God, as it has always been in the past, but conveniently forgotten, on the issue of racism and sexism and nativism, which the history of religion in America has been trying to push under the rug, so that we are not aware of the long discrimination against other groups, and including anti Semitism as well, along with the advocacy of slaughtering native Americans!

It is time for professional football to make it clear to its employees that it will no longer tolerate an atmosphere of homophobia in its locker rooms, and if so, then such players, no matter how prominent or outstanding they are on the football field, shall be kicked off the team, and no other team should employ such a bigot!

And the same goes for other organized sports, including baseball, hockey, and basketball! Behave and be tolerant, or else you are not welcome to play professional sports!

It is time to make it clear that homophobia, racism, sexism, and nativism will no longer be tolerated in American society, and that religious bigots, when revealed, shall be fought tooth and nail until it is eliminated!

This is not the 1950s, but instead it is the 21st century, so get used to it!

The Most Despicable Act: Utah Elementary School Throws Out Lunches For Poor Children!

So many outrages occur daily in this country in the past five years, all encouraged by the hardheartedness of the Republican Party, the conservative think tanks, the conservative talk show hosts, and the Tea Party Movement!

As each outrage occurs, one cannot help but become more frustrated, angry, furious, at “man’s inhumanity to man”, whether it be the 30 death threats daily against President Barack Obama; the cutting of unemployment compensation, food stamps, and refusal to raise the minimum wage one iota; the racial and ethnic hatred that continues to fester and boil over; the constant attack on the rights of women to their own bodies and dignity; the destruction of the middle class; the attack on labor rights; the vicious attacks by religious extremists on gay rights and same sex marriage; and a slew of other hateful, divisive, mean spirited statements and actions non stop!

But now a new low has been reached, hard to imagine that is possible!

Now we have a Salt Lake City, Utah elementary school, which has students whose parents are suffering from the long range effects of the Great Recession, and are behind in basic payments for school services of some kind. So their children, young kids under 10, are denied lunch, after it had been placed on trays for them, but then suddenly, the cafeteria manager takes the food away, because their parents are in arrears, and ends up throwing the food into the garbage, a total waste of taxpayers’ money!

How can ANYONE justify such an action, and the principal and the school board of Salt Lake City has refused to apologize directly to these unfortunate children, who are being sent a message that they are “garbage”, and are not worthy of being able to eat a meal with their friends and classmates?

Does one realize the psychological effect of such action on the psyches and self image of these children, who already live a more difficult life in poverty or deprivation, because of their parents’ unfortunate situation economically? It is as if there is no regard for human dignity, and everything is simply materialism, and if you do not have adequate money, to hell with you, and then throw out food that is not to be consumed by anyone else, and instead allow a child to go hungry!

But is this any different than the move to cut food stamps, when children of poor families are at least half of the recipients?

The cafeteria manager is on paid leave, but should be fired summarily, and the principal should be fired, and the school board should resign in disgrace!

And where is the Mormon Church, which dominates Utah politics and society, standing on this issue? They have been very silent, too busy fighting against gay rights and marriage, and forgetting that they were once victims of persecution and deprivation. But of course, now, the Mormon Church is a very well financed and prosperous group, that has lost the basis of its founding, nothing new, sadly, about organized religion, claiming to follow the teachings of its prophets, but doing just the opposite!

The Most Significant Long Range Events Of 2013

Now that we are in the last day of 2013, it is time to reflect on what the most significant long range events of 2013 are, events that will affect us in the future, and are signs of progress, which can never be reversed.

They include in no special order:

The accomplishment of national health care, a dream since Theodore Roosevelt first mentioned the concept in his Progressive Party campaign in 1912, later suggested by Harry Truman, partially enacted by Lyndon B. Johnson, attempted by Bill and Hillary Clinton unsuccessfully, promoted by Senator Ted Kennedy, and finally becoming law under Barack Obama. Even with all of the kinks and quirks now and in the future, national health care is here to stay, finally making America reach the stage of all other democracies in the world, but as usual the last to adopt social and economic reform, as compared to Europe, Canada, and Australia.

The acceptance by the Supreme Court of the concept of gay marriage, and the expansion from nine to eighteen states of acceptance of same sex marriage, and nothing will ever reverse what has happened, and eventually, the Supreme Court will mandate its legality throughout America, just as they did for interracial marriage in 1967. Many may not like it, but just as with interracial marriage, one does not have to engage in either interracial or same sex marriage, but it is nobody’s business to tell someone else who he or she is to love and to have the benefits of marriage, and no religious institution needs to accept it, as civil marriage will always be available.

The civil war raging in the Republican Party, which will determine if the party of Lincoln, TR, and Ike will survive or go into the dustbin of history, which Is certain, if the right wing Tea Party Movement is allowed to take over the party apparatus, and control the House and Senate Republican caucuses, and control major state governments around the nation. An extreme right wing Republican Party will not survive, and will give the Democrats such dominance that a moderate centrist party, maybe on the pattern of the Whig Party of Henry Clay, Daniel Webster, John Quincy Adams and Abraham Lincoln in the 19th century, will then emerge as a valid alternative to the more leftist Democratic Party by comparison.

The rise of a permanent Democratic majority in the Electoral College, as Georgia, Texas, Arizona and North Carolina will turn “blue” over the rest of the second decade of the 21st century, due to the growth in the Hispanic-Latino population, and the alienation of women from the Republican Party, which is working to control the reproductive lives of women. Both groups will swing these Sun Belt States to the Democrats, and with the Atlantic Coast from New England down to Virginia, and the Pacific Coast and the Upper Midwest more “blue” all of the time, there will be no way that Democrats will lose the White House over the next couple of decades, whether they nominate Hillary Clinton or Joe Biden, or someone else, for the Presidency in 2016 and beyond.

The Supreme Court will turn more liberal, as over the remaining years of this decade, the likelihood of new Supreme Court appointments, as well as circuit and district courts, will fall to Democratic Presidents, who no longer have to worry about a filibuster proof majority of 60 votes. The need for only 51 votes or 50 with the Vice President breaking the tie, insures that the courts, and eventually the high Court, will take a different view over time on same sex marriage, abortion rights, civil rights, and civil liberties, reminding one over the next two decades (due to lifetime appointments) of the history of the Warren Court.

2013 is coming to an end, and as always, there are stories and events that are very pleasant, and also those which are very disturbing.

The most pleasant stories of the year include in no particular order the following:

The Rise of Pope Francis, invigorating and reforming the Catholic Church, with his message of inclusion, compassion for the poor, and condemnation of unbridled capitalism.

The victory of Bill DeBlasio as Mayor of New York City, promoting a change in policy in a city which has catered to the wealthy, and ignored the poor and middle class.

The doubling of states which permit same sex marriage from nine to eighteen, and the growing acceptance of the American people to tolerance on the topic.

Senate filibuster reform on Presidential appointments, which allows the President to gain the people he wants for executive and judicial appointments, a right of any President, but prevented by Senate Republican intransigence.

The most disturbing stories of the year include in no particular order the following:

The Congressional deadlock caused by the Tea Party Movement in the Republican Party, including the government shutdown and dearth of Congressional activity.

The growing inequality and deprivation of the middle class and the poor, caused by a massive redistribution of wealth by tax policy over the years from Reagan to Bush II.

The Supreme Court backtracking on the Voting Rights Act guarantees after a half century, and the damage that continues to be done due to the Citizens United Case.

The rise of mean spirited, aggressive leaders including Senator Ted Cruz of Texas and Senator Rand Paul of Kentucky, both Tea Party favorites who work against compromise in any form.

Time For Gay Marriage Case Before Supreme Court, As With Interracial Marriage Case In 1967!

With recent gay marriage advancements in New Mexico and Utah, making it now a total of 18 states and Washington DC allowing same sex marriage, it is time for a case to come before the Supreme Court regarding the right of two gay men or two lesbians to be able to marry and be accepted as equal everywhere in the United States.

Just because many “religious” people, both Christian and Jewish, do not wish to accept gay marriage is not a reason to deny equal protection under the 14th Amendment to the Constitution.

No one is saying that any particular church or synagogue must perform gay marriages, or that everyone has to be happy and approving of such marriages.

Marriage should not be based on what others think about it, as it is a basic human right, that one has a right to be happy, to love whoever he or she chooses, and to have it acknowledged in civil law.

If one does not like gay marriage, fine, but one does not have the right to deny others because you have a problem with the lifestyle of others.

The same situation existed regarding interracial marriage, and only in 1967, in Loving V. Virginia, did the Supreme Court rule that no state or locality could ban or prevent two adults of any race from marrying.

Even back then, there were religious leaders and sects who disapproved of interracial marriage, and people were being prosecuted for trying to marry, or even living together.

Such a concept is oppressive government, and it is time for this to stop, and for all people to be given the right to do what they wish regarding relationships in their adult lives.

So Supreme Court, it is time to accept a case, maybe out of the Utah government fighting the new gay marriage edict of a federal judge, and to expand human rights, which is the whole basis of American democracy, and the sooner the better!

Gay Marriage Acceptance Building, As New Jersey Becomes 14th State To Adopt It

New Jersey became today the 14th state to allow gay marriage, making the entire Northeast ten of the 14 states that permit it.

All of the New England states (Maine, Vermont, New Hampshire, Massachusetts, Connecticut, Rhode Island), along with the Mid Atlantic states of New York, New Jersey, Delaware and Maryland, now have same sex marriage.

Additionally, Iowa and Minnesota in the Midwest have it, as well as Washington State and California on the Pacific Coast.

Waiting in the wings are Pennsylvania, Michigan, Wisconsin and Illinois in the Midwest (in different stages of the struggle for acceptance), and Colorado, Oregon and Hawaii in the West, making a likelihood of 21 states within the next year or two, which will have allowed such marriages.

This will mean about 155 million Americans will be living in states that permit same sex marriage by the end of 2014 or early 2015, nearly half the population of the nation, including also Washington, DC and New York City as municipalities which allow it.

There will still be vehement opposition to the concept of same sex marriage, but the reality is that it is here to stay for good, and will continue to spread nationwide over time.

Same Sex Marriage Advanced In Year Since Joe Biden Made It A Front Page Issue

It has been a year since Vice President Joe Biden publicly endorsed same sex marriage, followed three days later by a similar endorsement by President Barack Obama.

We are on the cusp of Minnesota becoming the 12th state to allow same sex marriage, with the states adopting it, including::

Massachusetts
Connecticut
Vermont
Maine
New Hampshire
Rhode Island
New York
Maryland
Delaware
Iowa
Washington

Following Minnesota, the following nine states are likely to adopt same sex marriage between now and the end of 2014:

Illinois
New Jersey
Hawaii
Michigan
Oregon
Colorado
New Mexico
Nevada
California

That will mean that 21 states with 45 percent of the nation’s population will have adopted same sex marriage as part of their law.

The only groups that oppose same sex marriage by a majority are:

Less educated Whites
Over 65 years of age
Republicans
Evangelical Protestants
Tea Party Movement

The South and the Great Plains, heavily Republican, are united against same sex marriage, while the New England and Mid Atlantic states, some of the Midwest, and the Pacific Coast, predominantly Democratic, are for it!

An Historic Moment In Evolution Of Human Rights In America!

America’s history has been one of slow evolution toward reform and change, and toward the expansion of human rights!

Today, May 9, 2012, is one of those moments that will reverberate as a memorable day in our history, as President Barack Obama has finally declared his full support for gay marriage, after having promoted action to promote gay rights in other ways earlier, including the end of “Don’t Ask, Don’t Tell” in the military.

To gay and lesbian Americans, and those who believe in gay and lesbian human rights, it was a long time coming, but that fact will now be forgotten in the excitement that our President has taken a very moral stand on gay rights, that despite many religious objections, means that over time, the institution of same sex marriage will spread far and wide as a civil right that all other people have, and that gay Americans are entitled to have.

Barack Obama will be long remembered for this great initiative, and Joe Biden will be long praised for having prodded the President to move in the final direction of full acceptance of what he was arriving at in an evolutionary fashion.

The hate mongers, common among Republicans and conservatives, will fight tooth and nail, as they did in the case of Amendment One in North Carolina, to deny equality, even to those military people on bases in the state, a despicable action.

But eventually, there will be a move to have the US Supreme Court decide whether it is not a national right, that cannot be denied by the states, but also mandate that no church, synagogue or other religious institution, would be required to marry people they did not want to be involved in marrying. That would be left up to ministers and rabbis comfortable with the idea, or to the act of civil marriage.

If the Supreme Court could declare in Loving V. Virginia in 1967, that interracial marriages were constitutional, they can certainly do the same for same sex marriage!

To insure such a result, however, it is MORE urgent than ever before that Barack Obama win a second term in the White House, and be able to insure that the Supreme Court does not become more conservative than it already is, and continue to prevent progress and change!

Religion And Same Sex Marriage: Not Uniform In Opposition!

The general impression that most Americans have is that all organized religious groups condemn the idea of same sex marriage, but nothing is farther from the truth!

Certainly, in a broad sense, the following groups DO oppose gay marriage with great vehemence: Evangelical Christians, the Catholic Church, Mormons, Orthodox Jews, African American Protestants, and Hispanic Pentecostals.

However, at the same time, the following groups often support the concept of gay marriage as legitimate: Mainline Protestant groups, including Episcopalian, Presbyterian, Methodist, United Church of Christ, and Lutherans, although all have splits on the issue; some rebel Catholic groups; and Reform Judaism.

It is clear that clergy were intimately involved in the passage of gay marriage in the New York State legislature, convincing a few Republicans to switch over to support, which would make the difference between victory and defeat.

Religious groups are divided on the subject, so one cannot say that those who speak for God are uniformly opposed, and progress has been made over the past decade in changing many religious groups to have an open mind and a tolerant view of promoting commitment and love outside the mainstream!
