The Dire Need For A Change In The Presidential Succession Act Of 1947

In 1947, the new Republican controlled 80th Congress, the first Congress to have both houses being Republican controlled since 1928, acted in revenge against the memory of Democratic President Franklin D. Roosevelt by changing the Presidential Succession Act of 1886.

That law in 1886 made the succession to the Presidency to be the cabinet officers after the Vice President, including in order, the Secretary of State, Secretary of the Treasury, Secretary of War, Attorney General, Postmaster General, Secretary of the Navy, and the Secretary of the Interior. The original law in 1792 made the President Pro Tempore of the Senate and the Speaker of the House next in line before the cabinet members, and after the Vice President.

This was changed to the present situation in 1947, that the Speaker of the House of Representatives, and then the President Pro Tempore of the Senate would succeed after the Vice President and before the cabinet officers.

This has  led to people in the line of succession who, much of the time, have been the opposition party to the President, as in 1947-1949 under President Harry Truman; 1955-1961 under President Dwight D. Eisenhower; 1969-1974 under President Richard Nixon; 1974-1977 under President Gerald Ford; 1981-1987 in the House under President Ronald Reagan; 1987-1989 under President Ronald Reagan; 1989-1993 under President George H. W. Bush; 1995-2001 under President Bill Clinton; 2001-2003 in the Senate under President George W. Bush; 2007-2009 under President George W. Bush; and 2011-2017 under President Barack Obama.

This is not proper, to have the opposition party have the potential to take over the Presidency through having a Speaker of the House and/or a President Pro Tempore of the Senate of their party, rather than having the continuity of the administration though the cabinet members chosen by the President.

So 44 years between 1947 and 2017, out of a total number of 70 years, or just about two thirds of the time, the opposition party has been two heartbeats away from the Presidency, undermining continuity of government.

Also, just because someone is Speaker of the House (elected by one Congressional district) or President Pro Tempore of the Senate ( an often very old person in that position, elected from one state, who has longevity of service) does not make such a person qualified to be President, as much as a Secretary of State, Treasury, etc does!

So while it is unlikely to happen anytime soon, there really is a need to change the Presidential Succession Act back to the one passed and in effect from 1886-1947!

House Speaker Becomes A Race: Kevin McCarthy, Jason Chaffetz, Or Daniel Webster? YES, Daniel Webster (Not The Famous One)!

There is now developing a real race for who should be Speaker of the House, in the wake of the resignation of John Boehner.  It will make us miss Boehner, for all of the faults and shortcomings he possesses!

Present House Majority Leader Kevin McCarthy has flubbed badly in his comment on the House Benghazi Committee investigating the attack in Libya which led to the death of the ambassador and three others on September 11. 2011.  That committee has been in business longer than any special committee in the history of the United States, and is seen as a purely partisan venture. McCarthy made it clear that the committee was formed to weaken  Democratic front runner Hillary Clinton, and now has tried to backtrack that statement, infuriating Jason Chaffetz of Utah, head of the House Committee on Oversight and Government Reform, who has decided to challenge McCarthy for the Speakership.

McCarthy comes across as incompetent and a poor candidate to be two heartbeats away from the Presidency, and his inability to use good judgment on what to say publicly, plus his lack of experience (only nine years), lack of accomplishments, and his use of words such as “Hungria” for the nation “Hungary”. and making up a new word for Hillary Clinton (untrustable) instead of “untrustworthy”, raises intelligent people’s eyes.

But Chaffetz himself, while better spoken, has only seven years in the House, two fewer than McCarthy, and he was a former Democrat, who actually campaigned for Democrat Michael Dukakis for President in 1988, before meeting former President Ronald Reagan in 1990, seemingly transforming his  life.

To top it off, Florida Congressman Daniel Webster from central Florida, a distant relation of the famous Massachusetts Senator of the same name before the Civil War, but no match for his ancestor, is also in the race, and is seen as a Tea Party candidate for the Speakership.

This whole embarrassment of the battle between McCarthy, Chaffetz, and Webster makes clear that the nation is in trouble, having to look at any of these three men as being two heartbeats away from the Presidency, and it will make us wish John Boehner had not resigned.

And the job to make the House Republicans be united and responsible, with the Tea Party element of 40 or so members the balancing act, means tough times ahead for the GOP, and gives a glimmer of hope that the Democrats might, maybe, be able to squeak out a majority of seats in the 2016 elections, but considered highly unlikely!

Kevin McCarthy, Incompetent And Unqualified, Soon To Be Two Heartbeats From The Presidency!

There have been many complaints over the past five years about Speaker of the House John Boehner, from the far right, and from the left, but at least we knew that Boehner had 20-25 years experience and was at least, basically, competent.

Now, with Boehner’s resignation, we are soon to be stuck with California Congressman Kevin McCarthy as the next Speaker, a man who admits that the Benghazi, Libya hearings were simply designed to weaken Democratic Presidential contender Hillary Clinton, and that the doctored Planned Parenthood videos are a ploy to help promote the anti abortion movement, and uses a word that does not exist, that Hillary Clinton is “untrustable”! He also called the nation of Hungary “Hungria”!

McCarthy is seen as better than Tea Party rivals, who would love to take over the Speakership, but McCarthy, with the least experience in Congress of any Speaker in more than a century, a total of only nine years and no special accomplishments and only two bills passed (both perfunctory), is someone to be concerned about as being only two heartbeats away from the Presidency!

Kevin McCarthy can be compared to former Vice President Dan Quayle in his looks and lack of any sign of intellect, and also to Sarah Palin, who also was good looking but lacking the brain power to be close to the Presidency!

What is it about the GOP that they find “good looking” men and women, who have no brains or intellect, and are a sign of the worst among us, putting the nation into danger by being so close to the Presidency, as Quayle was for 4 years; as Palin could have been for eight years: and as McCarthy now seems to be for at least the next 14 months, if not more?

America deserves much better than this!

The Crisis In The Speakership Of The House Of Representatives: Not A Laughing Matter!

The Speaker of the House of Representatives is, under the Presidential Succession Act of 1947, second in line for the Presidency behind the Vice President of the United States.

Therefore, who is the Speaker of the House is not an idle matter, but of crucial importance, that he or she be a mainstream, responsible public official.

The Republican Party has produced disasters in the Speakership since 1994.

First, we had Newt Gingrich, who had a scandalous private life, and was extremely confrontational in his dealings with President Bill Clinton, and yet, right wing conservatives were unhappy with him, and he resigned after two terms as Speaker, a total of four years.

Then, his theoretical successor, Bob Livingston, was forced to turn down the Speakership, due to his own private life scandals.

Then, Denny Hastert became Speaker, seemed noncontroversial, and in comparison to Gingrich and Livingston, was just that.  But now, years after his decision to leave Congress after the Republicans lost control of the House in 2006, Hastert faces prosecution and is involved in a sex scandal involving when he was a high school wrestling coach 35 years ago.

And then, there was John Boehner, who lasted almost five years, but was under constant attack by the far right Tea Party Movement, and now has decided to resign at the end of October.  Boehner created constant confrontations with Barack Obama, but also, at times, was cordial with limits imposed by his party’s dynamics.

Eric Cantor, who was supposed to be Boehner’s successor, unexpectedly lost his seat in a nomination fight last year, just as he had the chance to become the first Jewish Speaker of the House, and his defeat apparently delayed Boehner’s decision to leave, until now after the Pope has visited the United States, and spoken before the Congress in joint session.  This event brought out the tears so common to Boehner, a devout Catholic.

Now the issue is who should succeed Boehner, two heartbeats away from the Presidency, with new House Majority Leader Kevin McCarthy  of California favored even though he has only been in Congress nine years, has sponsored no important legislation, and never would have been in this position had Eric Cantor not been defeated  last year.

McCarthy seems pleasant enough on a personal basis, actually more than Gingrich, Livingston, Hastert, and now Boehner, but will the right wing Tea Party movement be satisfied with him, and will he be responsible enough to conduct himself with a willingness to work with President Obama for the next year?

What if a true right wing extremist ends up as Speaker, with House Majority Whip Steve Scalise, a possible successor seen as a true extremist and often compared by many to David Duke, the former KKK leader, due to Scalise’s opposition to a Martin Luther King Holiday in Louisiana, one of the last states to adopt it?

America cannot tolerate a right wing extremist to be two heartbeats away from the Presidency, and it can be hoped that, under the present circumstances, Kevin McCarthy become Speaker, but somehow, although unlikely, hope that disillusionment with the Republican control of Congress leads to Democratic control of the House, as well as the Senate, to occur in the 2016 national elections.

Since the House is gerrymandered, giving the GOP control despite more total popular votes for the chamber being Democratic, this seems unlikely, but those who feel it is urgent that the next Democratic President have both chambers of Congress willing to work with him or her, must work very hard to try to elect a Congress controlled by the Democrats!

80 Years Of Social Security And Counting: The Most Successful “Safety Net” Program In American History!

On August 14, 1935 the Social Security Act became law during the administration of Franklin D. Roosevelt, with Senator Robert F. Wagner of New York and Secretary of Labor Frances Perkins key figures in promoting its passage.

For the first time, there was the pledge of providing senior citizens with some financial support in their later years.

Additionally, widows and orphans, and the disabled would be covered under the law.

The US was behind Germany, Great Britain, and France, industrialized nations which had enacted such legislation decades earlier.

There was bipartisan support from progressive Republicans and from Democrats, but more conservative Republicans set as their goal to destroy Social Security, as early as the Presidential Election of 1936.

But Social Security has survived eight decades, and has done so much good for the nation, and its most vulnerable citizens.

Even now, there are proposals to change Social Security, as was done in 1983, by a deal between President Ronald Reagan and House Speaker Thomas “Tip” O’Neill, raising the retirement to age 66 and 67 for full benefits, depending on year of birth.

Now there is the call to raise the retirement age further, and cut benefits over the long haul, bitterly opposed by progressives and Democrats. Also, George W. Bush tried to privatize part of Social Security, which failed of enactment in 2005, but again is being promoted by House Ways and Means Committee Chairman Paul Ryan.

The tax base has been raised, but even now, only the first $118,500 is taxed, and many feel there should be no limit on the tax base, as that allows those who make much higher incomes to avoid further taxation, and putting the burden on the average American who does not earn more than $118,500.

The point is that by raising the tax base to unlimited income would insure the long term survival of Social Security.

It is essential to insure that the most successful “Safety Net” program in American history continued to survive and prosper!

A Proposal To Change Presidential Succession Law Back To Before 1947 Revision

It is clear, to anyone who really analyzes the situation, that the Presidential Succession Law of 1947 needs to be rolled back to what it was between 1886-1947.

The earlier succession law provided that the President’s cabinet members, starting with the Secretary of State, would follow the Vice President in the line of Presidential succession.

The 1947 law changed that to the Speaker of the House of Representatives and the President Pro Tempore of the Senate as ahead of the cabinet members.

That has been a mistake, as it has caused those two office holders often to be from the opposition party, as under Harry Truman 1947-1949; Dwight D. Eisenhower 1955-1961; Richard Nixon 1969-1974; Gerald Ford 1974-1977; Ronald Reagan 1987-1989 and also for the Speaker from 1981-1987; George H. W. Bush 1989-1993; Bill Clinton 1995-2001; George W.Bush 2001-2003 for the President Pro Tempore, and 2007-2009; and Barack Obama 2011-2017.

That is 38 years out of 70, and also six years for the Speaker and two years for the President Pro Tempore in addition, for a grand total of 46 of 70 years, two thirds of the time.

This has helped to promote stalemate and gridlock much too often, and has led to lack of continuity fear if a President had left office.

Luckily, that only happened twice in the first 27 years, and now it is 41 years since the last President left office early, a trend that is defying American history for turnover of the Presidency during a term, which happened seven times between 1841 and 1945!

The Secretaries of State have often been major figures, and since foreign policy is so crucial now, more than ever, the need for a Secretary of State to be second in line to be President, and a Secretary of the Treasury to be third in line, outweighs the idea of an often mediocre Congressman and a overly aged US Senator being next in line instead! And the importance of party loyalty and support of the President in office also is a major factor.

The Inauspicious Beginning Of The Republican 114th Congress: 25 Republicans Repudiate John Boehner, And White Supremacist Steve Scalise Kept As House Majority Whip!

The opening of the Republican controlled 114th Congress was an embarrassment in two major ways.

First, while Speaker John Boehner began his third two year term in that position, he suffered the repudiation of 25 members of his caucus, who refused to support him, making for the largest rebellion against a sitting Speaker in 150 years, since the Civil War era. Instead, these 25 rebels voted for Florida Congressman Daniel Webster (a distant descendant of the great Massachusetts Senator of the 19th century; Texas Congressman Louie Gohmert; Florida Congressman Ted Yoho; Kentucky Senator Rand Paul; former Army General Colin Powell; and others, making a joke out of the proceedings.

Then, despite the outcry against Louisiana Congressman Steve Scalise, who spoke at a David Duke sponsored event in 2002, claiming not to know that Duke sponsored the event, failed to stop him from being kept on as House Majority Whip. Scalise had claimed in the past that he was a “David Duke Republican”, but now claims ignorance of the racist, antisemitic career of the former Ku Klux Klan leader and his connections to the American Nazi Party. Duke ran for Governor and Senator in the early 1990s in Louisiana, and former President George H. W. Bush led the fight against his candidacy for Governor in 1991, but somehow, Scalise was not affected by that history, and was wiling to connect himself to Duke. Yet, the GOP decided to keep him as third ranking Republican in the House.

So a very inauspicious beginning for the GOP, as they try to convince the American people that they represent the nation, and should gain the White House, as well as Capitol Hill, in 2016!

Republican Insanity In The House Of Representatives As Speaker John Boehner Is Challenged By Louie Gohmert And Ted Yoho!

The 114th Congress is due to open on Tuesday, and this first all Republican Congress since the end of 2006 should be one for the books, in a negative way!

Having come off two successive Congresses (112th and 113th), which set records for the most incompetent, unaccomplished Congresses in modern American history, with both having a divided Congress, rare in American history, we can now expect total breakdown, craziness, and outrage to become the norm ever more.

It all begins with a last minute challenge within the GOP to the leadership of Speaker of the House John Boehner of Ohio, who has been seen as the worst modern Speaker in many decades!

Boehner has had trouble controlling his own caucus members in the past four years as Speaker, and had a challenge to his second two year Speakership two years ago, but now he faces another threat to be dumped by his caucus when it meets on Tuesday.

The largest Republican caucus since 1929, but with fewer Tea Party members as a percentage of the total, Boehner should have no problem disposing of his opponents, but the whole idea that two lunatic members of the right wing fringe Tea Party are challenging him, is in itself memorable as to just how much insanity there is the Republican Party of 2015!

Who would think that two of the most looney members of the Republican Party–Louie Gohmert of Texas and Ted Yoho of Florida—would believe they are qualified to lead the House, and be two heartbeats away from the Presidency as a result?

Gohmert, in the House since 2005, joined the loonies of the loonies—Michele Bachmann of Minnesota and Steve King of Iowa—in being part of the “Three Stooges”—the most embarrassing trio in Congress, bare none, and now Ted Yoho, a newcomer as of two years ago, has been competing to join this trio, which now lacks Michele Bachmann, who retired at the end of the last Congress, under investigation for corruption in her 2012 Presidential campaign, which marked the looniest campaign for the White House in memory. Yoho, with a name like that, desperately wants to be noticed, and is unwilling to allow Gohmert to get all the attention, so is making it a two pronged attack on the Speaker.

This should insure that Boehner keeps the position, even though, by all same judgments, he should be kicked out as someone who has disgraced the office, and desperately needs Alcoholics Anonymous, as everyone knows, but few speak out, that he has a major drinking problem that needs attention!

What a statement that the best that the GOP can conjure up for the Speakership of the “People’s Branch”, is Boehner, Gohmert, and Yoho!

The 113th Congress, Worst In Modern History, Refuses To Take Responsibility, And Enact A Resolution Backing War Against ISIL (ISIS)!

The 113th Congress is a disgrace, having passed fewer bills than ever in modern history; refusing to cooperate on anything with President Barack Obama, and now unwilling to take action to back the President with a formal war resolution against ISIL (ISIS) in the period leading up to the Midterm Elections, and even in the lame duck period after the election and until the 114th Congress convenes in January!

This is a disgrace, as it is the job of Congress to work with the President on war issues, and all they care about is campaigning, and keeping their jobs, with the great salary and benefits!

Since the Speaker of the House, John Boehner,  controls the calendar, the Republicans are to blame for ignoring the responsibilities of Congress to the American people!

If the people had sense, they would kick the GOP out of House control and insure the return of a Democratic majority in the US Senate!

Have We Gone From Speaker John Boehner To Speaker Ted Cruz?

The Tea Party Republicans in the House of Representatives have made life miserable for Speaker of the House John Boehner, blocking actions he has wished to take over the past two years, and now again, they are blocking any action on the immigration crisis of Central American women and children at the US-Mexico border!

Instead, the Tea Party Republicans are stalling any action, on the advice and prodding of Texas Senator Ted Cruz, which is privately infuriating Boehner and mainstream conservatives in the GOP!

So, apparently, for the first time in American history, a lunatic right winger in the Senate, and his name is NOT Joseph McCarthy, is undermining his own party in the lower chamber, while laying waste to doing as much damage as possible to the Senate, and its GOP leader, Senator Mitch McConnell of Kentucky!

So civil war is occurring, and it is causing disrespect for John Boehner and Mitch McConnell, and it is hard to imagine the scenario in January 2015, if the GOP keeps the House of Representatives and gains control of the US Senate!

The odds of a Speaker Boehner are dwindling rapidly, and we could end up with a Tea Party Ted Cruz backed Republican as Speaker of the House, so new Majority Leader Kevin McCarthy of California had better pay heed!
