The Calm Before The Storm

If one is a proud progressive or liberal, as this blogger is, it is hard not to be squirming today as one contemplates the likelihood of two major setbacks for the progressive movement in America this week from the United States Supreme Court.

The majority of experts and prognosticators forecast a 5-4 vote against the Affordable Care Act and for the Arizona immigration law restrictions.

Both such events would be terrible setbacks, and hard to overcome in the short run for sure, and probably in the long run as well.

Some say a defeat on the Obama Health Care law would lead ultimately to Medicare for all within a couple of years, and that defeat on the Arizona SB 1070 would lead to comprehensive immigration reform within two years, as well.

But all that only seems possible IF the Democrats win both houses of Congress and the Presidency again in November.

The theory is that two defeats administered by the right wing Supreme Court by 5-4 margins, on top of the Citizens United case and the Bush V. Gore case of twelve years ago would so galvanize the American people, who are progressives, to organize, unify, vote en masse to promote the necessary changes.

But when one considers the great edge financially that the right wing has with billionaires ready to spend hundreds of millions of dollars individually to back Mitt Romney and the Republican Party in Congress, including the Koch Brothers and Sheldon Adelson among others, one has to wonder if even such organization and unity and discipline by progressives will be enough, particularly when added to the active campaigns of Republican Governors to purge the voting rolls, and defy the Voting Rights Act of 1965.

One can hope for the best on all fronts, but it is hard not to be pessimistic and a bit depressed on this Sunday before the storm likely to erupt this week, by a one vote margin created by the outrage of George W. Bush being selected President over Al Gore a dozen years ago, and still reverberating in 2012 and, likely, beyond!

The Justice Department Throws Down The Gauntlet To Florida Governor Rick Scott: Stop Illegal Purging Of Voter Rolls!

The Justice Department under Attorney General Eric Holder has finally taken action, throwing down the gauntlet to Florida Governor Rick Scott to cease and desist from illegal purging of the voter rolls in the Sunshine State, including the elderly, Latinos and Hispanics, African Americans, and others, including college students.

A 91 year old man, who has voted consistently for 70 years and served in World War II, was told he could not vote. Others who have had the right are being denied it with threatening letters, putting them under unnecessary stress about a basic American right, the right to vote.

Florida is right now breaking the Voting Rights Act of 1965, which included Florida because of its past discrimination against African Americans, and their long history of racial segregation and racial violence.

Scott is lawless, reckless, defiant, abusive, and a disgrace to all law abiding Floridians! Having evaded prison for Medicare fraud, he is arrogant and aggressive in setting out to fix the 2012 Presidential Election in the same fashion of denying the right to vote, as occurred in the Presidential Election of 2000, leading to the disastrous eight years of George W. Bush!

It is good to see that the Obama Administration is not going to allow prejudice, corruption, scandal, and discrimination to interfere with the right to vote!

In many ways, this situation sadly reminds us of Alabama Governor George Wallace and Georgia Governor Lester Maddox, two racists who disgraced their states and the nation during the 1960s, with their attacks on civil rights. What Rick Scott is doing will doom his name in history, but then it must be said that it is doubtful that Scott even cares what damage and harm he is doing to his reputation, since he is such a despicable human being!

If only the recall method was allowed in Florida as it is in many other states, including Wisconsin, which will determine the fate of another “Bully” Governor, Scott Walker, next Tuesday!

Nicholas Katzenbach Dead: Major Figure In 1960s Issues Under Presidents Kennedy And Johnson

Another veteran of the Kennedy-Johnson era, Nicholas Katzenbach, has died at the age of 90.

Not as well remembered as others, partly because he wished to avoid the spotlight, Katzenbach was actually an extremely important figure, as Under Secretary of State, Deputy Attorney General, and Attorney General.

The author has the memory of Katzenbach confronting Alabama Governor George Wallace in June 1963, at the University of Alabama, when Wallace tried to block the registration of two black students, and Katzenbach took a firm stand, and Wallace stepped aside. Few more dramatic moments have occurred in a public place, with no one sure what would happen!

But Katzenbach was also involved in the integration of the University of Mississippi by James Meredith in 1962; the defense of the Vietnam War before congressional committees; the investigation of the assassination of President Kennedy; advice during the Cuban Missile Crisis; passage of the Civil Rights Act of 1964 and the Voting Rights Act of 1965; and struggles with J. Edgar Hoover of the FBI, but supportive of Robert F. Kennedy, the Attorney General before him.

The 1960s era fades ever more in history with the death of Nicholas Katzenbach.

March 30: Important Date In History In Many Ways, Including A Personal One!

Today, March 30, is a very significant date in American history.

It is the day in 1981 that President Ronald Reagan was seriously wounded in an assassination attempt, but survived, recovered, and went on to serve two full terms as the 40th President.

It is also the day in 1867 when Secretary of State William Seward signed the treaty arranging for the purchase of Alaska from Czarist Russia for $7.2 million, becoming infamously known as “Seward’s Folly”, It was fortunate that the United States bought Alaska, because if it had remained Russian, imagine the security problems for Canada and the United States during the Cold War years with the Soviet Union!

And it was the day in 1870 that the 15th Amendment, granting African American men the right to vote, was finally ratified and added to the Constitution. Sadly, the South would soon disobey the amendment, and successfully take away the right to vote until the passage of the Voting Rights Act under President Lyndon B. Johnson in 1965, guaranteeing federal intervention to insure everyone’s right to vote. Now the Republican Party in many states, including, most grievously the state of Florida under Governor Rick Scott and a dominant state legislature, is making it more difficult for people to register and vote, particularly the elderly, the poor, college students, and the poor.

And, in the mind of this author, March 30 is MOST significant because in 1984, his younger son Paul was born, and has brought joy and pride to his father and brother and uncle now for 28 years!

The Ides Of March: Significant In The Past And The Present!

Today, March 15, marks the anniversary of the assassination of Julius Caesar in the Roman Republic in 44 BC, so well depicted by William Shakespeare.

But in America, it is marked by the speech of President Lyndon B. Johnson in 1965, calling for the Voting Rights Act to stop discrimination in voting for African Americans in the South.

Ironically, 47 years later, we are seeing many states, primarily in the South and Midwest, trying to deny the right to vote for the elderly, college students, the poor, and minorities by onerous Voter ID requirements, in many cases for people who have voted for decades without trouble, but now are being told they cannot vote in this year’s Presidential election.

This is all designed by Republicans and conservatives in their effort to defeat President Barack Obama by any means they can find, because they do not have the issues to win the election without utilizing dishonesty. And yet they claim they are trying to prevent voter fraud, which is only a few cases in many millions, far less than even one thousandth of one percent in the past decade!

So the Obama Administration, through Attorney General Eric Holder, has brought lawsuits against South Carolina and Texas, as well as Arizona and Alabama on other issues of racial and ethnic discrimination related to voting and basic human rights. And many Midwestern and Southern states, other than those mentioned, are also setting out to abuse the Voting Rights Act, trying to take us back to the era of Jim Crow voter laws, that denied poor and minority voters their basic rights!

Also, today marks the beginning of what is seen as an end to our engagement in Afghanistan, as President Hamid Karzai is calling for Allied forces to retreat to bases, and remove themselves from Afghan villages. This is the reaction to the tragic massacre by one American soldier last week, the murder of 16 civilians, including nine children and three women and four men, as they slept in their village a mile away from an American military base; and the earlier burning of Korans by American soldiers, leading to the killing of several soldiers by Taliban terrorists.

America has been in Afghanistan more than a decade, and the war is leading to no improvement worth the continuation of the sacrifice of our troops, or those of our allies.

Afghanistan has been the doom of Alexander the Great in the ancient world; the British Empire in the 19th century; the Soviet Union in the late 20th century; and now the US and allied nations in the 21st century! It is time to expedite our exit, and just use drones and the air force against Taliban and Al Qaeda terrorists. Making Afghanistan a democracy is, sadly, a lost cause!

So March 15 past and present has significant meanings we must not forget!

The Republican Motivation For Power: Take Away Human Rights Already Granted!

America has developed over the past two centuries into a republic promoting democratic values and the advancement of human rights.

The Republican Party of 2011-2012, however, is making clear its desire to TAKE AWAY human rights already won over the past two centuries, with blood, sweat and tears!

We have seen the acquisition of voting rights in the 15th, 19th, 23rd, 24th, and 26th Amendments, as well as with the Voting Rights Act of 1965, and yet now, the Republican Party in many states is working very hard to LIMIT the right to vote by unreasonable limitations that particularly affect African Americans, Hispanics and Latinos, college students, the elderly and the poor of all races!

Women have gained the right to control their own privacy, including control of their own bodies, through a Supreme Court decision in Roe V. Wade in 1973 and other Supreme Court decisions and legislative actions, and yet now in many of our states, the attempt to take away women’s rights, including the right of abortion, is being fiercely waged, including encouragement of violence against abortion providers and closing down of locations where a woman can pursue her reproductive rights.

Gay men and lesbians have gained the right to serve in the military openly, be married in several states, adopt children in most states, and have other basic human rights, but now the move is on to take away these rights so hard fought for!

Working people, both immigrants and those born in the US, have fought for labor protection and representation through formation of labor unions, which have now been undermined for decades, and the attempt to impoverish workers by corporations and their Republican allies is in full development!

This has been a land of immigrants, and yet the Republican Party of today believes in polarizing Americans against undocumented immigrants who they would support deporting in the millions, even with the fact that 98 percent of them have committed no crime beyond entering the nation in an illegal manner, and just want the opportunity to work toward eventual citizenship through learning English, paying fees, and waiting patiently in line for the “American Dream”, and yet now work at low wage jobs that no Americans wish to fill, particularly in agriculture, retail, and home and hotel services.

Americans in general have been able to see improved educational opportunities, better health care, and opportunities for better housing and safer environment and consumer protection due to past Democrats and moderate Republicans working to better conditions for the middle class and the poor, but now the goal of the GOP is to take away these advancements and simply promote the interests of the top one percent and the corporations that sit on money, refuse to hire, and instead use government money that saved them to give bonuses to overpaid, under worked executives, and to lobby corrupt politicians who do their bidding!

Will the nation at large continue to accept an opposition party that works to DENY all of the progress on voting rights, women’s rights, gay rights, labor rights, immigrant rights, and the advancements for the middle class and poor gained over two centuries?

Only if the people are appealed to based upon ignorance, emotion, prejudice, and manipulation! For the future of America, this cannot be allowed to happen, as it will undermine the social fabric of America for the long haul!

Florida Republicans Attempting To Prevent Young Voter Registration And Prosecute Teachers Who Promote Good Citizenship!

The Republican Party of Florida and Governor Rick Scott are in the process of promoting prosecution of teachers who encourage their high school seniors to register to vote, the ultimate lesson in good citizenship.

The new voter registration law in Florida, very similar to that in other GOP governed states, makes it much more difficult for people to register to vote, requiring government sponsored ID cards; making it harder for college students to vote on their campuses; cutting down the number of days of voting ahead of Election Day; requiring people who change counties to cast a provisional ballot at the polls, which might not be counted; discouraging the League of Women Voters from promoting registration due to a demand that all signed applications must be handed in no later than two days after applications are completed; and assessing fines of up to $1,000 for delayed submission of applications.

Two teachers are facing fines for having missed the 48 hour deadline for student applications, which prosecutes teachers for promoting good citizenship, and discourages new, young voters.

It is clear that the GOP and Governor Scott are trying to intimidate minorities, young people, the elderly, and the poor so as to manipulate the vote to favor the Republican Presidential nominee in 2012. This is a violation of the Voting Rights Act of 1965; the 14th Amendment; the 15th Amendment; the 19th Amendment; the 24th Amendment; and the 26th Amendment; and is being pursued in court as a corrupt attempt to fix election results in Florida, as well as elsewhere, by the Obama Administration.

Meanwhile, however, two teachers face fines, and this is another slap in the face to educators, who already have been shown lack of respect by other legislation in Florida which demeans their profession!

A Generation Of Justice Clarence Thomas: Its Negative Impact!

Supreme Court Associate Justice Clarence Thomas has now been on the Court for a generation, and his impact is clear.

This is a man who was enmeshed in controversy when he was appointed by President George H. W. Bush to replace Associate Justice Thurgood Marshall as the second African American in the history of the Supreme Court. He was clearly the “anti Marshall”, and has remained in controversy ever since 1991.

Thomas was accused by African American law professor Anita Hill of sexual harassment, and accused liberals of a “lynching”, and only was approved by a vote of 52-48 in the Senate, the closest of the 20th century. He has, in a memoir in 2007 and before and since, continued to have bitterness and resentment toward liberals and his other critics, and said when he was confirmed that he would confound the “damn liberals” by staying on the Court for 43 years, the age he was when appointed, which would surpass Justice William O. Douglas’s 36 years on the Court, the longest in Supreme Court history. His wife strangely contacted Anita Hill last year to ask for an “apology”, which was not forthcoming, but continues to simmer in his wife’s mind after a generation.

Thomas’s wife has been involved in ethical problems as the head of a conservative organization working against the Obama Health Care law, and in other ways, working with the Tea Party Movement, while her husband is involved in decisions where his wife’s activities create ethical problems for him, although he is unwilling to react to any criticism by recusing himself from cases, as creating a conflict of interest. He does not care what his critics say!

On the Court, he is seen in many ways as the MOST conservative member, even more than Antonin Scalia in some ways. He is well liked by his colleagues, but almost never asks any questions in oral arguments before the Court. He gives lectures around the country, but avoids the news media. He comes across as bitter and odd in many ways, but also arrogant and hard to fathom.

Thomas has shown willingness to strike down case law going back decades, and sometimes even a century. He is the only one to argue for consistent return to the “original” meaning of the Constitution when it was adopted in 1789, even more than Antonin Scalia. He sees the Court as having gone the wrong way in many areas of the law, and wanting reversal of past rulings.

Thomas alone believes that states should be able to establish an official religion; believes teenagers have no free speech rights at all; believes business should not be regulated and their commercial speech and campaign activities should not be regulated; wants to strike down a key provision of the Voting Rights Act; and backs the President’s ability to hold an American citizen in prison indefinitely without charges or review by the courts.

Thomas refuses to see prisoner rights as legitimate and is against affirmative action to the extreme, even though he benefited from it himself! He spends his time only with people who agree with his hard line views, which many think is a shame, as it indicates he has a closed mind.

So Clarence Thomas continues to have a long range, in many ways deleterious effect on the Supreme Court, and probably will for close to another generation, as he predicted!

Rush Limbaugh And The Ultimate Right Wing Agenda: Reverse The Social And Economic Progress Since World War II!

Radio talk show host Rush Limbaugh is on a roll with the Debt Ceiling Crisis and the Stock Market Crisis of the past few weeks, and he has declared war on all social and economic progress for the past 65 years, since World War II! Other right wing radio talk show hosts also promote what he does!

Actually, showing his total ignorance, Limbaugh probably means the past 80 years, since the New Deal of Franklin D. Roosevelt in the 1930s!

By declaring, in any case, that it is time to reverse the past 65 years, that means the following:

1. The Harry Truman improvements on the New Deal programs of FDR.
2. Reversal of Truman’s executive order to enforce racial integration in the military.
3. Reversal of racial integration as ordered by the Supreme Court and enforced by Presidents Eisenhower, Kennedy and Johnson.
4. Reversal of Eisenhower’s acceptance of the New Deal and institutionalizing it.
5. Wiping out of the programs of the New Frontier of JFK and the Great Society of LBJ–including Medicare, Medicaid, Federal Aid to Education, Consumer Protection Laws, Civil Rights and Voting Rights Act, programs to fight poverty, Environmental laws, National Public Radio, Public
Broadcasting, and other programs.
6.Ending of Richard Nixon’s domestic reforms–including the Occupational Safety and Health Administration, Environmental Protection Agency, Consumer Products Safety Commission, Affirmative Action programs, and others.
7.Ending of programs to aid the disabled and handicapped, begun under George H W Bush.
8. Other reforms passed under Jimmy Carter, Bill Clinton, and now Barack Obama.

This is totally insane, and the progressive movement MUST fight tooth and nail to prevent such total destruction of everything which has made America a better nation, a more tolerant nation, a more compassionate nation!

We cannot afford to go back to the 1920s, and there is no way that this agenda of Rush Limbaugh and his ilk can be allowed to triumph!

Bill Clinton Reminds Us About “Jim Crow” Voting Restrictions On Blacks, Warns Against Them Returning!

Former President Bill Clinton has made a major speech criticizing Republican Governors and legislatures passing restrictions on voting rights, comparing them to the old “Jim Crow” restrictions that ruled the South for nearly one hundred years until passage of the Voting Rights Act of 1965.

The new restrictions being promoted and put into law with the backing of Florida Governor Rick Scott, Wisconsin Governor Scott Walker, Ohio Governor John Kasich, and many other Republican Governors would require drivers license ID cards to vote, shorten hours and days of early voting, require college students to vote at home instead of where they live, and restrict felons who have completed their obligation to society from being able to cast their vote. The theory is that these states are trying to prevent voter fraud, which in reality, is a very slight problem historically!

This is all designed to harm groups–African Americans, Latinos, the young, and the poor–who are perceived as likely to vote for Democrats.

Clinton reminding us of “Jim Crow” should lead to law suits to stop this new limitation and discrimination of the right to vote, something supposedly overcome by Lyndon B. Johnson in the 1960s as part of his Great Society.

Somehow, we seem to repeat history’s mistakes over and over again!
